J.H. Mahaney is a partner with extensive trial and appellate experience in commercial and tort litigation. Mr. Mahaney has represented transportation companies, energy companies, mineral owners, resorts, commercial real estate developers and other commercial clients in class actions, mass tort matters, catastrophic tort claims, commercial and complex litigation, business litigation, construction litigation, professional liability claims and employment law claims. He has handled legal matters for clients in state and federal courts in West Virginia, Kentucky, Ohio and North Carolina, with an outstanding record of success in some of the regions most difficult trial venues.
For example:
Mr. Mahaney was lead trial counsel for a Fortune 500 company in a multi-defendant mass tort case against landowners, coal companies and timber companies for catastrophic flood damage. The case was advantageously settled after weeks of trial, and subsequent indemnity actions for reimbursement of the settlement amounts and litigation costs were successfully prosecuted.
In an ongoing matter, Mr. Mahaney is representing a large natural gas producer in a class action fraud and breach of contract claim involving the calculation and payment of mineral owner royalties.
Mr. Mahaney was lead trial counsel for a transportation company sued by an employee for career ending injuries. A month long trial in Pike County, Kentucky resulted in a defense verdict.
He is currently defending an exclusive resort and its developer in multi-million dollar fraud and breach of contract action.
Mr. Mahaney routinely represents architects, engineers, contractors and owners in all aspects of construction projects, including contract negotiations, contract administration, mechanics liens, construction defect and change order litigation and professional liability claims.
He has represented a variety of professionals in both business and professional liability claims, including accountants, actuaries, attorneys and real estate professionals.
Mr. Mahaney represented a Fortune 500 company in a multistate litigation utility pipeline right-of-way litigation. After prevailing at injunction hearings in both state and federal courts, a resolution was reached allowing on-time completion of the proposed projects.
Mr. Mahaney is listed in the Best Lawyers in America in the areas of Commercial Litigation, Mass Tort Litigation and Railroad Litigation. He is also listed by West Virginia Super Lawyers for his work in Business Litigation.
Mr. Mahaney is a native of West Virginia, and graduated from Bethany College in 1989, magna cum laude. In 1992, he graduated from the Washington & Lee University School of Law where he was a member of The Order of the Coif. After practicing law in New Mexico for three years, he returned to West Virginia in 1995.
